1. Definitions

The following terms are used in these Terms and Conditions and Your Order Summary:

If You make a $60 lump-sum payment, plus applicable taxes, at the time of purchase, Your Protection Plan is valid for one year beginning on the Coverage Start Date stated in Your Order Summary.

If You make monthly subscription payments, Your Protection Plan is valid for one calendar month beginning on the date of Your most recent successful monthly payment. Coverage will continue for as long as You continue making monthly payments, until You cancel the Protection Plan, or until IMS cancels the Protection Plan, whichever occurs first.

You may cancel Your next monthly payment by providing notice more than 14 days before the payment is due.

IMS reserves the right to cancel future payments and coverage by providing 30 days' notice, except in cases involving non-payment, fraud, or material misrepresentation.

  • "Protection Plan Price" means the price You paid for this Protection Plan, as stated in Your Order Summary.
  • "Coverage Start Date" means the date on which Your coverage begins under this Protection Plan, as stated in Your Order Summary.
  • "Coverage Term" or "Term" means the period during which Your coverage is active.
  • "Coverage Amount" means the maximum amount You may claim from IMS under the Protection Plan, as stated in Your Order Summary.

Core Definitions

  • "We," "Us," and "Our" mean the obligor of this Protection Plan, International Mobile Services (IMS). You may contact Us at support@internationalmobile.ca or +1 613-845-0444.
  • "Administrator" means International Mobile Services (IMS), located at 3-4025 Innes Road, Orleans, Ontario K1C 1T1, Canada.
  • "Protection Plan" means the IMS Care Premium Protection Plan.
  • "You" and "Your" mean the individual or entity that purchased this Protection Plan. This Protection Plan is not transferable.
  • "Terms and Conditions" mean these IMS Care Premium Protection Plan Terms and Conditions.
  • "Date of Purchase" means the date on which the Protection Plan was purchased from Us.
  • "Order Summary" means the written or electronic record of Your original Protection Plan purchase.
  • "Covered Product" means the single device for which You purchased the Protection Plan. No replacement device or component provided under this Protection Plan will qualify for additional protection unless IMS expressly confirms otherwise in writing.
  • "Coverage Amount" means the maximum coverage amount under this Protection Plan. It is equal to the replacement price of Your Covered Product, less any applicable Deductible.
  • "Deductible" means the applicable amount You must pay for an approved claim.

2. Coverage

This Protection Plan covers qualifying mechanical or electrical failures of the Covered Product during normal use within the Coverage Term.

The Protection Plan does not replace the manufacturer's warranty. It provides certain additional benefits during the manufacturer's warranty period and for the remaining Coverage Term.

At IMS's discretion, replacement parts may be new, rebuilt, refurbished, or compatible non-original manufacturer parts that perform substantially according to the Covered Product's applicable factory specifications.

Each approved claim is subject to the applicable Deductible plus applicable sales taxes. The Deductibles are detailed in Section 3.

IMS may require You to return the original defective battery before receiving a replacement battery.

IMS may also require You to provide the surge protector for inspection when submitting a power-surge claim.

  • normal wear and tear;
  • a defective original rechargeable battery, as determined by IMS;
  • damaged or defective buttons;
  • damaged or defective charging, audio, or connectivity ports;
  • defective pixels;
  • dust affecting the internal operation of the Covered Product;
  • internal overheating;
  • internal humidity or condensation;
  • defects in materials or workmanship;
  • an operational failure caused by a power surge while the Covered Product was properly connected to a surge protector;
  • a cracked or accidentally damaged display screen;
  • accidental liquid damage; or
  • accidental exposure to water or other liquids.

Defective Pixels

IMS will apply the Covered Product manufacturer's defective-pixel policy during the Coverage Term.

If the manufacturer does not have a defective-pixel policy, IMS will cover a display with at least three defective pixels located within a one-square-inch area of the display.

Exclusions

This Protection Plan does not cover:

  • any replacement device or replacement component provided under this Protection Plan;
  • any pre-existing condition that occurred before the Coverage Start Date;
  • intentional, deliberate, fraudulent, or malicious damage;
  • lost, stolen, or irretrievable devices or other items;
  • any product that was fraudulently described or materially misrepresented;
  • damage resulting from use contrary to the manufacturer's specifications or owner's manual;
  • damage caused by exposure to extreme weather conditions;
  • failure to properly clean, maintain, or care for the Covered Product;
  • reckless misuse, abuse, or vandalism;
  • damage caused by an improper electrical supply or incompatible power source;
  • damage caused by unauthorized equipment modifications, attachments, installation, or assembly;
  • battery leakage caused by misuse or an incompatible component;
  • damage caused by storms, tornadoes, hurricanes, floods, earthquakes, fires, or other natural events;
  • defects caused by the initial installation, assembly, or connection of the Covered Product;
  • claims submitted under an improperly or incorrectly purchased Protection Plan;
  • cosmetic damage to the case, frame, cabinet, or other non-operating components that does not affect the Covered Product's functionality;
  • a Covered Product with a removed, altered, or unreadable serial number or IMEI;
  • defects or equipment failures covered by the manufacturer's warranty, recall, service campaign, or factory bulletin;
  • shipping damage that occurred before the Coverage Start Date;
  • routine cleaning or preventive maintenance;
  • a "No Problem Found" diagnosis;
  • intermittent or non-intermittent issues that are not caused by a product failure;
  • poor cellular reception, weak network coverage, or problems caused by a telecommunications provider;
  • software, applications, operating-system updates, passwords, user accounts, or digital content; or
  • loss of photographs, contacts, messages, files, or other data.

Shipping

The Protection Plan covers authorized shipping charges to and from an IMS-approved service centre during the Coverage Term.

This includes authorized shipping to the manufacturer if the manufacturer does not cover the shipping charges.

You must receive authorization from IMS before shipping the Covered Product. IMS will not reimburse unauthorized shipping expenses.

3. Claims

To make a claim under this Protection Plan, contact the IMS Customer Success Team at support@internationalmobile.ca or +1 613-845-0444.

Do not ship the Covered Product until You receive authorization and shipping instructions from IMS.

Depending on the Covered Product, the type of failure, and the circumstances of the claim, IMS may, at its discretion:

  • Your Order Summary;
  • proof of purchase;
  • the Covered Product's serial number or IMEI;
  • photographs or videos of the damage;
  • a description of the failure and how it occurred;
  • the results of reasonable troubleshooting steps; or
  • the Covered Product for inspection.
  1. repair Your Covered Product;
  2. provide a cash settlement or gift card reflecting the replacement cost of a product with equivalent features and functionality, up to the Coverage Amount; or
  3. replace Your Covered Product with a product of comparable type, quality, features, and functionality.

Replacement Device

A replacement device may be new or professionally refurbished. The manufacturer, model, colour, finish, or storage capacity may differ if an identical replacement is unavailable, provided that the replacement has substantially comparable features and functionality.

Deductible Schedule

Each approved claim is subject to a Deductible based on the Covered Product's pre-tax purchase price. Applicable sales taxes will be added to the Deductible.

The Repair Deductible applies when IMS repairs the Covered Product.

The Replacement Deductible applies when IMS replaces the Covered Product, provides a cash settlement, or provides a gift card instead of repairing the Covered Product.

4. Cancellation

Cancellation by IMS

IMS may cancel this Protection Plan because of non-payment, fraud or attempted fraud, material misrepresentation, an incorrectly identified Covered Product, a claim relating to a device other than the Covered Product, or a material violation of these Terms and Conditions.

IMS will provide notice of the cancellation. Where applicable, You will receive a prorated refund for the unused portion of the Coverage Term.

If IMS cancels the Protection Plan for non-payment, IMS will provide notice at the time of cancellation.

Cancellation by You

You may cancel this Protection Plan at Your discretion. Where applicable, You will receive a prorated refund for the unused portion of the Coverage Term.

To cancel the Protection Plan, send a written request by email to support@internationalmobile.ca.

You may also mail Your request to International Mobile Services (IMS), 3-4025 Innes Road, Orleans, Ontario K1C 1T1, Canada.

5. Limit of Liability

The total amount IMS will pay for repairs, replacements, cash settlements, gift cards, or other approved benefits relating to all claims under the Protection Plan will not exceed the Coverage Amount.

The cost of every approved repair, replacement, or settlement reduces the remaining Coverage Amount.

IMS will have no further obligations under the Protection Plan when the total value of approved repairs or replacements reaches the Coverage Amount, IMS provides a replacement device, IMS provides a cash settlement or gift card, the Protection Plan expires, or the Protection Plan is cancelled.

No replacement device or component provided under the Protection Plan will qualify for additional protection unless IMS expressly confirms otherwise in writing.

You are responsible for backing up and removing Your personal information before submitting the Covered Product for repair or replacement.

Nothing in these Terms and Conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited.

  • property damage;
  • lost time;
  • loss of use;
  • lost income;
  • loss of business; or
  • loss of photographs, contacts, messages, applications, files, or other data resulting from the failure, repair, replacement, or loss of any product.

6. Consumer Rights and Disputes

Nothing in this Protection Plan limits any right or remedy available to You under the Ontario Consumer Protection Act, 2002 or other applicable law.

You may commence or participate in a court or class proceeding where permitted by applicable law. After a dispute arises, You and IMS may voluntarily agree to mediation, arbitration, or another lawful dispute-resolution process.

These Terms and Conditions are governed by the laws of Ontario and the applicable federal laws of Canada.

7. Entire Agreement

These Terms and Conditions and Your Order Summary constitute the complete agreement between You and IMS concerning the Protection Plan.

There are no other representations, warranties, or agreements between You and IMS concerning the Protection Plan unless confirmed by IMS in writing.

If any provision of these Terms and Conditions is determined to be unlawful or unenforceable, that provision will be limited or removed only to the extent required by law. The remaining provisions will continue to apply.
